Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Zapeat and the services at https://zapeat.in (the “Service”). Please read them carefully.
1. Acceptance of terms
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation. If you do not agree, do not use the Service.
2. The Service
Zapeat is an AI-assisted website builder that lets you create, edit, host and publish websites, and optionally publish content to social accounts you connect. The Service captures enquiries and leads through website forms. The websites you build are lead-capture only and must not be used as an e-commerce checkout or to take online payments from your visitors. Separately, Zapeat charges you for paid plans, domains and add-ons as described below.
3. User accounts
You are responsible for your account and for keeping your login credentials secure. You must provide accurate information, be at least 16 years old, and promptly notify us of any unauthorised use. You are responsible for all activity under your account.
4. AI-generated websites and content
The Service can generate text, layouts and images using AI. AI output may be inaccurate, incomplete, outdated or unintentionally similar to existing material. You are responsible for reviewing, editing and verifying all AI-generated content before publishing it, and for ensuring it is lawful and does not infringe others’ rights. We make no warranty that AI output is accurate, original or fit for any particular purpose.
5. User-generated content
You retain ownership of the content you add (text, images, media). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce and display that content solely to operate the Service and to publish your sites and posts as you direct. You represent that you have all rights necessary to your content and that it does not violate any law or third-party right.
6. Website hosting
We host the sites you publish on our infrastructure and provide subdomains, and optionally custom domains. We aim for high availability but do not guarantee uninterrupted or error-free service, and we may perform maintenance. You are responsible for the content and legal compliance of the sites you publish.
7. Subscription plans
The Service offers free and paid subscription plans with different features and usage limits (such as sites, AI generations, connected accounts, storage and domains). Paid plans renew automatically for the billing period you select unless cancelled before the renewal date. We may change plan features, limits or pricing prospectively, with notice where reasonable; changes do not affect the period you have already paid for.
8. Payments
Payments for subscriptions, domain registrations and renewals, and add-ons are processed by Razorpay. By purchasing, you authorise us and Razorpay to charge your selected payment method for the applicable fees, taxes and renewals. Card and banking details are handled by Razorpay under its PCI-DSS-compliant systems; we do not store your full card details. All fees are stated in the currency shown at checkout and are inclusive or exclusive of taxes as indicated.
9. Refund policy
Subscription fees are generally non-refundable except where required by law. If you cancel a paid plan, you retain access until the end of the current billing period and are not charged again. Domain registrations and renewals are non-refundable once purchased, as they are paid to and fulfilled by the domain registrar. If you believe you were charged in error or experienced a failed transaction, contact support@zapeat.in within 7 days and we will investigate in good faith.
10. User responsibilities
You are responsible for the accuracy, legality and appropriateness of the content and businesses you promote through the Service, for complying with applicable laws (including advertising, consumer-protection and data-protection laws), and for obtaining any consents required from your own website visitors.
11. Prohibited activities
You agree not to use the Service to: publish unlawful, infringing, defamatory, harmful, deceptive or adult/harassing content; spam or send unsolicited messages; distribute malware; scrape, reverse-engineer, overload or gain unauthorised access to the Service; resell or misrepresent the Service; or breach the policies of any connected platform (Google, Meta/Facebook, Instagram, LinkedIn). We may remove content or suspend accounts that violate these Terms.
12. Intellectual property
The Service — including its software, design, templates, block library and branding — is owned by Zapeat and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You keep ownership of your own content; we keep ownership of the Service and of the underlying templates and components (your licence to use them ends if your account ends). You may not copy, modify or create derivative works of the Service except as expressly permitted.
13. Third-party APIs and integrations
The Service integrates with third-party platforms. Your use of these integrations is also governed by each provider’s terms and policies, and we are not responsible for third-party services.
- Google Business Profile (Google OAuth): connecting Google lets you manage the business listing you authorise. Our use of Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements.
- Facebook Login and Instagram Graph API (Meta): connecting a Facebook Page or Instagram account lets you publish content you create. Use is subject to the Meta Platform Terms and Developer Policies.
- LinkedIn OAuth: connecting LinkedIn lets you publish content you create to your authorised profile or page, subject to the LinkedIn API Terms of Use.
We publish to connected accounts only when you ask us to, and you can disconnect any integration at any time from your dashboard.
14. Availability and changes
We may modify, suspend or discontinue parts of the Service, and update these Terms. We will provide notice of material changes where reasonable; continued use after changes take effect means you accept the updated Terms.
15. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law, including any warranty of merchantability, fitness for a particular purpose or non-infringement.
16. Limitation of liability
To the maximum extent permitted by law, Zapeat will not be liable for indirect, incidental, special, punitive or consequential damages, or for loss of data, profits, revenue or goodwill arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid to us for the Service in the 12 months before the event giving rise to the claim.
17. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or use the Service unlawfully. On termination, your right to use the Service ends and we may delete your data in line with our Privacy Policy; provisions that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) will survive.
18. Governing law and jurisdiction
These Terms are governed by the laws of India, including the Information Technology Act, 2000 and applicable rules, without regard to conflict-of-laws principles. Subject to any mandatory consumer-protection rights, the courts of India will have exclusive jurisdiction over disputes arising from these Terms or the Service.
